Terms and Conditions of the FajneCiuchy24.pl online store
specifying, among others, the rules for concluding sales contracts through the Store, containing the most important information about the Seller, the Store, and Consumer rights
Provisions concerning the privileged Entrepreneur apply to contracts concluded from January 1, 2021.

§ 1 DEFINITIONS
Business days – days from Monday to Friday excluding public holidays.
Consumer – a consumer within the meaning of the provisions of the Civil Code.
Account – a free Store feature regulated by a separate regulation (service provided electronically), thanks to which the Buyer can create their individual account in the Store.
Buyer – any entity purchasing in the Store.
Privileged Buyer – Consumer or Privileged Entrepreneur.
Privileged Entrepreneur – a natural person concluding an agreement with the Seller directly related to their business activity, but not having a professional character for it (definition applies to agreements concluded from January 1, 2021).
Pickup point – the point located at Fajne Ciuchy, ul. Pasaż Ursynowski 3 lok. 4, 02-784 Warsaw.
Terms and Conditions – these terms and conditions.
Store – the online store FajneCiuchy24.pl run by the Seller at https://fajneciuchy24.pl.
Seller – NAOTEX Sp. z o.o. Spółka Komandytowa with its registered office at ul. Złota 61 lok. 100, 00-819 Warsaw, entered in the National Court Register - register of entrepreneurs by the District Court for the capital city of Warsaw in Warsaw XII Commercial Division of the National Court Register, under number KRS 0000425217, NIP 5272679936, REGON 146180049.
§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS
- For the proper functioning of the Store, the following are needed:
- To place an order in the Store, apart from the requirements specified in section 1, an active email account is necessary.
§ 4 PURCHASES IN THE STORE
- The prices of goods visible in the Store are the total prices for the goods.
- The Seller points out that the total price of the order consists of the price for the goods indicated in the Store and, if applicable in a given case, the delivery costs of the goods.
- The goods selected for purchase must be added to the cart in the Store.
- Then the Buyer selects from those available in the Store: the method of delivery of the goods and the payment method for the order, and also provides the data necessary to fulfill the placed order.
- The order is placed at the moment of confirming its content and accepting the Terms and Conditions by the Buyer.
- Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.
- The Seller will provide the privileged Buyer with confirmation of the sales contract on a durable medium no later than at the moment of delivery of the goods.
- The Buyer may register in the Store, i.e. create an Account, or make purchases without registration by providing their data with each potential order.
§ 5 PAYMENTS
- Payment for the placed order can be made, depending on the Buyer's choice:
- In the case of choosing payment via the Blue Media payment platform, the entity providing online payment services is Blue Media S.A.
- In the event of a refund for a transaction made by the customer with a payment card, the seller will refund to the bank account linked to the Buyer's payment card.
- If the Buyer chooses prepayment, the order must be paid within 4 business days from placing the order.
- The Seller informs that for some payment methods, due to their nature, payment for the order using that method is only possible immediately after placing the order.
- By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw their acceptance.
§ 6 ORDER FULFILLMENT
- The Seller is obliged to deliver goods free from defects.
- The order fulfillment time is indicated in the Store.
- If the Buyer has chosen prepayment for the order, the Seller will proceed with order fulfillment after payment is made.
- If the customer chooses payment by bank transfer or payment card, the order fulfillment time is counted from the day the Seller's bank account or settlement account is credited.
- In the situation where the Buyer has purchased goods with different fulfillment dates within one order, the order will be fulfilled within the timeframe applicable to the goods with the longest delivery time.

- Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:
- The Buyer may collect the goods personally at the Pickup Point during its opening hours.
- In the case of choosing personal pickup by the Buyer, the goods will be ready for collection on the specified order fulfillment date, and if the Seller indicated the shipping date – on that date.
§ 7 RIGHT OF WITHDRAWAL FROM THE CONTRACT
- A privileged Buyer has the right to withdraw from the contract concluded with the Seller via the Store, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.
- The withdrawal period expires 14 days after the day:
- For a privileged Buyer to exercise the right of withdrawal, they must inform the Seller, using the data provided in § 2 of the Terms and Conditions, of their decision to withdraw from the contract by means of a clear statement (for example, a letter sent by mail or information sent by email).
- A privileged Buyer may use the withdrawal form template placed at the end of the Terms and Conditions, but it is not mandatory.
- To meet the deadline for withdrawal from the contract, it is sufficient for the Privileged Buyer to send the information concerning the exercise of the right of withdrawal before the withdrawal deadline expires.
EFFECTS OF WITHDRAWAL FROM THE CONTRACT - In the event of withdrawal from the concluded contract, the Seller will refund the Privileged Buyer all payments received from them, including the costs of delivering the goods (except for additional costs resulting from the Privileged Buyer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller), immediately, and in any case no later than 14 days from the day the Seller was informed of the Privileged Buyer's decision to exercise the right of withdrawal.
- The Seller will refund the payment using the same payment methods used by the Privileged Buyer in the original transaction, unless the Privileged Buyer agrees to a different solution; in any case, the Privileged Buyer will not incur any fees related to this refund.
- The Seller may withhold the refund until receiving the goods or until the proof of their return is provided, whichever occurs first.
- The Seller requests that goods be returned to the address: ul. Piwonińska 68, 08-443 Sobienie Jeziory immediately, and in any case no later than 14 days from the day the Privileged Buyer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Privileged Buyer sends back the goods before the 14-day period expires.
- The Privileged Buyer bears the direct costs of returning the goods.
- The Privileged Buyer is only responsible for the reduction in the value of the goods resulting from using them in a way other than necessary to establish the nature, characteristics, and functioning of the goods.
- If the goods, due to their nature, cannot be returned by regular mail, the Privileged Buyer will also have to bear the direct costs of returning the goods. The estimated amount of these costs will be informed to the Privileged Buyer by the Seller in the product description in the Store or during the order placement.
- In the event of the necessity to refund the transaction made by the Privileged Buyer using a payment card, the Seller will refund to the bank account linked to that payment card.
§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL FROM THE CONTRACT
- The right to withdraw from a distance contract, referred to in § 7 of the Regulations, does not apply to the contract:
§ 9 COMPLAINTS
- In the event of a defect in the goods, the Consumer has the right to claim the defective goods based on the warranty regulated in the Civil Code or guarantee, if a guarantee has been provided.
- By using the warranty, the Consumer may, under the terms and within the deadlines specified in the Civil Code:
- The Seller requests that complaints based on warranty be submitted to the postal or electronic address indicated in § 2 of the Terms and Conditions.
- If it turns out that to consider the complaint it is necessary to deliver the defective goods to the Seller, the Consumer is obliged to deliver these goods at the Seller's expense to the address ul. Piwonińska 68, 08-443 Sobienie Jeziory.
- If an additional warranty has been granted for the goods, information about it, as well as its conditions, is available in the product description in the Store.
- Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Terms and Conditions.
- The Seller will consider the complaint within 14 days.
OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND CLAIMS - If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:
§ 10 PERSONAL DATA
- The administrator of the personal data provided by the Buyer while using the Store is the Seller. Detailed information regarding the processing of personal data by the Seller – including other purposes and bases for data processing, as well as data recipients – can be found in the Privacy Policy available in the Store – due to the transparency principle contained in the General Data Protection Regulation of the European Parliament and Council (EU) – “GDPR”.
- The purpose of processing the Buyer's data by the Seller, provided by the Buyer in connection with purchases in the Store, is to fulfill orders. The basis for processing personal data in this case is:
- Providing data by the Buyer is voluntary but at the same time necessary to conclude the contract. Failure to provide data will make it impossible to conclude a contract in the Store.
- The Buyer's data provided in connection with purchases in the Store will be processed until: – depending on what applies in the given case and what occurs last.
- The Buyer has the right to request:
- To exercise their rights, the Buyer should contact the Seller using the data from § 2 of the Terms and Conditions.
- If the Buyer considers that their data is being processed unlawfully, the Buyer may file a complaint with the President of the Personal Data Protection Office.
§ 11 RESERVATIONS
- It is prohibited for the Buyer to provide content of an unlawful nature.
- Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Terms and Conditions. The contract is concluded for the duration and purpose of fulfilling the order.
- Contracts concluded under the Terms and Conditions are concluded in Polish.
- In the event of a potential dispute with a Buyer who is not a privileged Buyer, the competent court shall be the court having jurisdiction over the Seller's registered office.
- All Seller's liability towards the Buyer who is not a privileged Buyer, within the limits permitted by law, is excluded.
- Liability under warranty towards the privileged Entrepreneur is excluded.
