in the FajneCiuchy24.pl store
Provisions concerning the privileged Entrepreneur apply to contracts concluded from January 1, 2021.

§ 1 DEFINITIONS
Consumer – a consumer within the meaning of the provisions of the Civil Code.
Account – a free Store function (service) regulated in these terms and conditions, through which the Buyer can create their individual account in the Store.
Buyer - any entity purchasing in the Store.
Privileged Buyer – Consumer or Privileged Entrepreneur.
Privileged Entrepreneur – a natural person concluding an agreement with the Seller directly related to their business activity, but not having a professional character for it (definition applies to agreements concluded from January 1, 2021).
Store – the online store FajneCiuchy24.pl run by the Seller at https://fajneciuchy24.pl
Seller - NAOTEX Sp. z o.o. Spółka Komandytowa with its registered office at ul. Złota 61 lok. 100, 00-819 Warsaw, entered in the National Court Register - register of entrepreneurs by the District Court for the capital city of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000425217, NIP 5272679936, REGON 146180049.

§ 3 TECHNICAL REQUIREMENTS
- For the proper functioning and creation of the Account, the following are required:
§ 4 ACCOUNT
- Creating an Account is completely voluntary and depends on the Buyer’s will.
- The Account gives the Buyer additional possibilities, such as: viewing the history of orders placed by the Buyer in the Store, checking the order status, or independently editing the Buyer’s data.
- To create an Account, you must fill out the appropriate form in the Store.
- At the moment of creating the Account, an indefinite agreement is concluded between the Buyer and the Seller regarding the management of the Account under the terms indicated in these regulations.
- The Buyer may resign from the Account at any time without incurring any costs.
- To resign from the Account, you must send your resignation to the Seller at the e-mail address: sklep@fajneciuchy24.pl, which will result in the immediate deletion of the Account and termination of the agreement regarding the management of the Account.
§ 5 COMPLAINTS
- Complaints regarding the functioning of the Account should be sent to the e-mail address sklep@fajneciuchy24.pl.
- The Seller will consider the complaint within 14 days.
OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND CLAIMS - If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:
§ 6 PERSONAL DATA
- The administrator of the personal data provided by the Buyer while using the Account is the Seller. Detailed information regarding the processing of personal data by the Seller – including other purposes and legal bases for data processing, as well as data recipients – can be found in the Privacy Policy available in the Store – due to the transparency principle contained in the General Data Protection Regulation of the European Parliament and Council (EU) – "GDPR".
- The purpose of processing the Buyer's data is Account management. The basis for processing personal data in this case is the service contract or actions taken at the Buyer's request aimed at concluding it (Art. 6(1)(b) GDPR), as well as the Seller's legitimate interest in processing data to establish, pursue, or defend possible claims (Art. 6(1)(f) GDPR).
- Providing data by the Buyer is voluntary but at the same time necessary for managing the Account. Failure to provide data means that the Seller will not be able to provide the Account management service.
- The Buyer's data will be processed until: – depending on what applies in the given case and whichever occurs latest.
- The Buyer has the right to request:
- To exercise their rights, the Buyer should contact the Seller.
- If the Buyer considers that their data is being processed unlawfully, the Buyer may file a complaint with the President of the Personal Data Protection Office.
§ 7 RESERVATIONS
- It is prohibited for the Buyer to provide content of an unlawful nature.
- The contract regarding Account management is concluded in the Polish language.
- In the event of important reasons referred to in paragraph 4, the Seller has the right to change these Account regulations.
- Important reasons referred to in paragraph 3 are:
- The Buyer will be informed about the planned change to the Account regulations at least 7 days before the change comes into effect via an e-mail sent to the address assigned to the Account.
- If the Buyer does not accept the planned change, they should inform the Seller by sending an appropriate message to the Seller's e-mail address sklep@fajneciuchy24.pl, which will result in the termination of the contract regarding the Account management upon the planned change taking effect or earlier if the Buyer requests so.
- If the Buyer does not object to the planned change until it comes into effect, it is assumed that they accept it, which does not prevent the contract from being terminated in the future.
- In the event of a potential dispute with a Buyer who is not a privileged Buyer, the competent court shall be the court having jurisdiction over the Seller's registered office.
