Account Terms and Conditions
in the FajneCiuchy24.pl store
Provisions concerning the Privileged Entrepreneur apply to agreements concluded from January 1, 2021.

§ 1 DEFINITIONS
Consumer – a consumer within the meaning of the Civil Code provisions.
Account – a free Store feature (service) regulated in these terms, allowing the Buyer to create their individual account in the Store.
Buyer - any entity purchasing in the Store.
Privileged Buyer – Consumer or Privileged Entrepreneur.
Privileged Entrepreneur – a natural person concluding an agreement with the Seller directly related to their business activity but not having a professional character for it (definition applies to agreements concluded from January 1, 2021).
Store – the online store FajneCiuchy24.pl operated by the Seller at https://fajneciuchy24.pl
Seller - NAOTEX Sp. z o.o. Spółka Komandytowa with its registered office at ul. Złota 61 lok. 100, 00-819 Warsaw, registered in the National Court Register - entrepreneurs register by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number 0000425217, NIP 5272679936, REGON 146180049.

§ 3 TECHNICAL REQUIREMENTS
- For the proper functioning and creation of the Account, the following are required:
§ 4 ACCOUNT
- Creating an Account is completely voluntary and depends on the Buyer’s will.
- The Account provides the Buyer with additional features, such as: viewing the order history placed by the Buyer in the Store, checking the order status, or editing the Buyer’s data independently.
- To create an Account, fill out the appropriate form in the Store.
- When the Account is created, an indefinite agreement is concluded between the Buyer and the Seller regarding the management of the Account under the terms specified in these regulations.
- The Buyer may cancel the Account at any time without incurring any costs.
- To cancel the Account, send your cancellation to the Seller at the email address: sklep@fajneciuchy24.pl, which will result in the immediate deletion of the Account and termination of the agreement regarding the Account management.
§ 5 COMPLAINTS
- Complaints regarding the Account functionality should be sent to the email address sklep@fajneciuchy24.pl.
- The Seller will review the complaint within 14 days.
OUT-OF-COURT METHODS FOR HANDLING COMPLAINTS AND CLAIMS - If the complaint procedure does not yield the result expected by the Consumer, the Consumer may use, among others:
§ 6 PERSONAL DATA
- The controller of the personal data provided by the Buyer while using the Account is the Seller. Detailed information about the Seller's data processing – including other purposes and legal bases for processing, as well as data recipients – can be found in the Privacy Policy available in the Store, in accordance with the transparency principle set out in the EU General Data Protection Regulation (“GDPR”).
- The purpose of processing the Buyer's data is to maintain the Account. The legal basis for processing personal data in this case is the service agreement or actions taken at the Buyer's request aimed at concluding it (Art. 6(1)(b) GDPR), as well as the Seller's legitimate interest in processing data to establish, pursue, or defend possible claims (Art. 6(1)(f) GDPR).
- Providing data by the Buyer is voluntary but necessary to maintain the Account. Failure to provide data means the Seller will not be able to provide the Account service.
- The Buyer's data will be processed until: – depending on what applies in the given case and whichever occurs latest.
- The Buyer has the right to request:
- To exercise their rights, the Buyer should contact the Seller.
- If the Buyer believes that their data is being processed unlawfully, the Buyer may file a complaint with the President of the Personal Data Protection Office.
§ 7 DISCLAIMERS
- It is prohibited for the Buyer to provide content of an unlawful nature.
- The Account agreement is concluded in Polish.
- In the event of important reasons referred to in section 4, the Seller has the right to change these Account regulations.
- Important reasons referred to in section 3 are:
- The Buyer will be informed about the planned change to the Account regulations at least 7 days before the change takes effect via an email sent to the address assigned to the Account.
- If the Buyer does not accept the planned change, they should inform the Seller by sending an appropriate message to the Seller's email address sklep@fajneciuchy24.pl, which will result in the termination of the Account agreement upon the planned change taking effect or earlier if the Buyer requests so.
- If the Buyer does not object to the planned change before it comes into effect, it is assumed that they accept it, which does not prevent the contract from being terminated in the future.
- In the event of a dispute with a Buyer who is not a privileged Buyer, the competent court will be the court having jurisdiction over the Seller's registered office.
