§ 1 DEFINITIONS

Business days – days from Monday to Friday excluding public holidays.
Consumer – a consumer within the meaning of the Civil Code provisions.
Account – a free Store feature regulated by a separate set of rules (an electronic service) that allows the Buyer to create their individual account in the Store.
Buyer – any entity purchasing in the Store.
Privileged Buyer – Consumer or Privileged Entrepreneur.
Privileged Entrepreneur – a natural person concluding an agreement with the Seller directly related to their business activity but not having a professional character for it (definition applies to agreements concluded from January 1, 2021).
Pickup Point – the point located at Fajne Ciuchy, ul. Pasaż Ursynowski 3 lok. 4, 02-784 Warsaw.
Terms and Conditions – these terms and conditions.
Store – the online store FajneCiuchy24.pl operated by the Seller at https://fajneciuchy24.pl.
Seller – NAOTEX Sp. z o.o. Spółka Komandytowa with its registered office at ul. Złota 61 lok. 100, 00-819 Warsaw, registered in the National Court Register - entrepreneurs register by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number 0000425217, NIP 5272679936, REGON 146180049.

§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS

  1. For the proper functioning of the Store, the following is needed:
  2. To place an order in the Store, apart from the requirements specified in section 1, an active email account is necessary.

§ 4 SHOPPING IN THE STORE

  1. The prices of goods visible in the Store are the total prices for the goods.
  2. The Seller points out that the total price of the order consists of the price for the goods indicated in the Store and, if applicable in a given case, the delivery costs of the goods.
  3. The goods selected for purchase must be added to the cart in the Store.
  4. Next, the Buyer selects from those available in the Store: the delivery method for the goods and the payment method for the order, and also provides the data necessary to fulfill the placed order.
  5. The order is placed at the moment the Buyer confirms its content and accepts the Terms and Conditions.
  6. Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.
  7. The Seller will provide the privileged Buyer with confirmation of the sales contract on a durable medium no later than at the time of delivery of the goods.
  8. The Buyer can register in the Store, i.e., create an Account, or make purchases without registration by providing their data with each potential order.

§ 5 PAYMENTS

  1. Payment for the placed order can be made, depending on the Buyer’s choice:
  2. If payment is made via the Blue Media payment platform, the entity providing online payment services is Blue Media S.A.
  3. If a refund is necessary for a transaction made by the customer with a payment card, the seller will refund the amount to the bank account linked to the Buyer’s payment card.
  4. If the Buyer chooses prepayment, the order must be paid within 4 business days from placing the order.
  5. The Seller informs that for some payment methods, due to their nature, payment for the order using that method is only possible immediately after placing the order.
  6. By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw their acceptance.

§ 6 ORDER FULFILLMENT

  1. The Seller is obliged to deliver goods free from defects.
  2. The order fulfillment time is indicated in the Store.
  3. If the Buyer chooses prepayment for the order, the Seller will start fulfilling the order after payment is received.
  4. If the customer chooses payment by bank transfer or payment card, the order fulfillment time is counted from the day the Seller’s bank account or settlement account is credited.
  5. If the Buyer purchases goods with different fulfillment dates within one order, the order will be fulfilled according to the longest fulfillment date among the goods.

  • Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:
  • The Buyer may collect the goods personally at the Pickup Point during its opening hours.
  • If the Buyer chooses personal pickup, the goods will be ready for collection on the specified order fulfillment date, or if the Seller has indicated a shipping date – on that date.

§ 7 RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. The privileged Buyer has the right to withdraw from the contract concluded with the Seller via the Store, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.
  2. The deadline for withdrawal from the contract expires 14 days after the day:

In order for the privileged Buyer to exercise the right of withdrawal from the contract, they must inform the Seller, using the contact details provided in § 2 of the Terms and Conditions, of their decision to withdraw from the contract by means of a clear statement (for example, a letter sent by mail or information sent by email).
  4. The Privileged Buyer may use the withdrawal form template placed at the end of the Terms and Conditions, but it is not mandatory.
  5. To meet the deadline for withdrawal, it is enough for the Privileged Buyer to send the information about exercising their right of withdrawal before the withdrawal period expires.

    EFFECTS OF WITHDRAWAL FROM THE CONTRACT
  6. In case of withdrawal from the concluded contract, the Seller will refund the Privileged Buyer all payments received from them, including delivery costs (except for additional costs resulting from the Privileged Buyer choosing a delivery method other than the cheapest standard delivery offered by the Seller), promptly and in any case no later than 14 days from the day the Seller was informed of the Privileged Buyer's decision to exercise the right of withdrawal.
  7. The Seller will refund the payment using the same payment methods used by the Privileged Buyer in the original transaction, unless the Privileged Buyer agrees to a different solution; in any case, the Privileged Buyer will not incur any fees related to this refund.
  8. The Seller may withhold the refund until receiving the product or until the proof of its return is provided, whichever occurs first.
  9. The Seller requests that the product be returned to the address: ul. Piwonińska 68, 08-443 Sobienie Jeziory immediately, and in any case no later than 14 days from the day the Privileged Buyer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Privileged Buyer sends back the product before the 14-day period expires.
  10. The Privileged Buyer bears the direct costs of returning the product.
  11. The Privileged Buyer is only responsible for any reduction in the product's value resulting from using it in a way other than what was necessary to establish the nature, characteristics, and functioning of the product.
  12. If the product, due to its nature, cannot be returned by regular mail, the Privileged Buyer will also have to bear the direct costs of returning the goods. The estimated amount of these costs will be communicated to the Privileged Buyer by the Seller in the product description in the Store or during the order process.
  13. In the event of a refund for a transaction made by a Privileged Buyer using a payment card, the Seller will refund the amount to the bank account linked to that payment card.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. The right to withdraw from a distance contract, referred to in § 7 of the Terms and Conditions, does not apply to contracts:

§ 9 CLAIMS

  1. In case of a product defect, the Consumer has the right to claim the defective product based on the warranty regulated in the Civil Code or the guarantee, if a guarantee has been provided.
  2. By using the warranty, the Consumer may, under the terms and deadlines specified in the Civil Code:
  3. The Seller requests that complaints based on warranty be submitted to the postal or electronic address indicated in § 2 of the Terms and Conditions.
  4. If it turns out that to consider the complaint it is necessary to deliver the defective product to the Seller, the Consumer is obliged to deliver this product at the Seller's expense to the address ul. Piwonińska 68, 08-443 Sobienie Jeziory.
  5. If an additional warranty has been granted for the product, information about it and its conditions is available in the product description in the Store.
  6. Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Terms and Conditions.
  7. The Seller will review the complaint within 14 days.

    OUT-OF-COURT METHODS FOR HANDLING COMPLAINTS AND CLAIMS
  8. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:

§ 10 PERSONAL DATA

  1. The administrator of the personal data provided by the Buyer while using the Store is the Seller. Detailed information regarding the processing of personal data by the Seller – including other purposes and legal bases for processing data, as well as data recipients – can be found in the Privacy Policy available in the Store – due to the transparency principle contained in the General Data Protection Regulation (GDPR) of the European Parliament and Council (EU) – "GDPR".
  2. The purpose of processing the Buyer's data by the Seller, provided by the Buyer in connection with purchases in the Store, is to fulfill orders. The basis for processing personal data in this case is:
  3. Providing data by the Buyer is voluntary but at the same time necessary to conclude the contract. Failure to provide data will make it impossible to conclude a contract in the Store.
  4. The Buyer's data provided in connection with purchases in the Store will be processed until: – depending on what applies in the given case and whichever occurs latest.
  5. The Buyer has the right to request:
  6. To exercise their rights, the Buyer should contact the Seller using the contact details from § 2 of the Terms and Conditions.
  7. If the Buyer believes that their data is being processed unlawfully, the Buyer may file a complaint with the President of the Personal Data Protection Office.

§ 11 RESERVATIONS

  1. It is prohibited for the Buyer to provide content of an unlawful nature.
  2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Terms and Conditions. The contract is concluded for the duration and purpose of fulfilling the order.
  3. Contracts concluded based on the Terms and Conditions are concluded in Polish.
  4. In the event of a dispute with a Buyer who is not a privileged Buyer, the competent court will be the court having jurisdiction over the Seller's registered office.
  5. All Seller's liability towards the Buyer who is not a privileged Buyer, within the limits permitted by law, is excluded.
  6. Liability under warranty towards the privileged Entrepreneur is excluded.
